Kreiso Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Kreiso website (kreiso.app), mobile application, and all related services (collectively, the "Service") operated by Nikita Konstantinovskiy, operating as Kreiso ("Kreiso," "we," "us," or "our").

By joining our waitlist, creating an account, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of the Service

Kreiso is a social connection platform that matches users into small groups for real-world activities and events. The Service includes:

  • A waitlist for early access
  • A compatibility survey and onboarding flow
  • An event discovery and recommendation feed
  • Group formation and group messaging for coordinated meetups
  • Post-event feedback collection

Kreiso facilitates introductions and organizes group activities. Kreiso is not responsible for what happens during or after events, and does not guarantee any particular social outcome.

2. Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you are 16 or older and have the legal capacity to enter into these Terms.

Certain events may carry an additional age requirement of 18 or older, for example events at alcohol-serving venues or nightlife activities. These restrictions are clearly marked on each event listing, and you agree not to commit to age-restricted events unless you meet the stated requirement.

3. Account Registration

To use the app, you must create an account using a valid phone number or email address via Firebase Authentication. You are responsible for:

  • Providing accurate and complete information during registration and onboarding
  • Maintaining the security of your account credentials
  • All activity that occurs under your account

If you believe your account has been compromised, notify us immediately at nikitakonst1@gmail.com.

We reserve the right to suspend or terminate accounts that contain false information.

4. Waitlist

By joining the waitlist, you consent to receiving communications from Kreiso about the Service launch and availability. You can unsubscribe from waitlist communications at any time by following the unsubscribe link in any email or by contacting us at nikitakonst1@gmail.com.

Joining the waitlist does not guarantee access to the Service or a spot in any cohort or event.

5. User Conduct

You agree to use the Service respectfully and in good faith. You must not:

  • Provide false or misleading information in your profile or survey responses
  • Harass, threaten, intimidate, or harm other users, whether through the Service or at events
  • Use the Service to promote commercial products, services, or solicitations to other users
  • Attempt to reverse-engineer, scrape, or extract data from the Service
  • Create multiple accounts
  • Impersonate another person
  • Use the Service for any illegal purpose
  • Disrupt or interfere with the Service or its infrastructure

We reserve the right to investigate violations and take action including warning, suspension, or permanent removal from the Service, at our sole discretion.

6. Events and Real-World Meetups

6.1 Kreiso's Role

Kreiso facilitates group formation and event coordination. We may suggest activities, recommend venues, and organize logistics. However:

  • Kreiso does not own, operate, or control any venues where events take place.
  • Kreiso does not employ, supervise, or control any users.
  • Kreiso is not a party to any interaction, agreement, or relationship between users.

6.2 Your Responsibility

When you commit to an event, you agree to:

  • Attend as committed, or cancel within a reasonable time
  • Behave respectfully toward other attendees and venue staff
  • Comply with venue rules and applicable laws
  • Take responsibility for your own safety and well-being

6.3 Assumption of Risk

Participation in real-world events involves inherent risks. By attending any event facilitated through Kreiso, you acknowledge and accept these risks, including but not limited to: risks associated with travel, physical activities, food and drink, interactions with other users, and conditions at third-party venues.

Kreiso is not liable for any injury, loss, damage, or harm arising from your participation in events or your interactions with other users, whether online or in person.

6.4 No-Shows and Cancellations

Repeated no-shows or last-minute cancellations negatively impact other users' experiences. We reserve the right to limit event access, reduce priority in event recommendations, or suspend accounts for users who repeatedly fail to attend committed events.

7. Payments

7.1 Fees

Certain events or features may require payment. Fees will be clearly displayed before you commit. All prices include applicable taxes unless stated otherwise.

7.2 Payment Processing

Payments are processed by Stripe. By making a payment, you agree to Stripe's terms of service. Kreiso does not store your payment card details.

7.3 Refunds

Refund eligibility depends on the specific event and cancellation timing. If you cancel within the cancellation window stated for the event, you are eligible for a full refund. Cancellations after the stated window or no-shows are not eligible for refunds unless the event is cancelled by Kreiso.

If Kreiso cancels an event (for example, due to insufficient commitments), all committed users will receive a full refund.

7.4 Deposits

Some events may require a deposit to secure your spot. Deposits are refunded if you attend the event. If you do not attend without cancelling within the stated window, the deposit may be forfeited.

8. Content

8.1 Your Content

You retain ownership of any content you submit through the Service, including profile photos, text, and feedback ("User Content"). By submitting User Content, you grant Kreiso a non-exclusive, worldwide, royalty-free license to use, display, and distribute your User Content solely for the purpose of operating and improving the Service.

You are responsible for your User Content and represent that it does not violate any third party's rights or any applicable law.

8.2 Content Moderation

We reserve the right to remove or restrict any User Content that violates these Terms or that we reasonably consider harmful, offensive, or inappropriate, without prior notice.

9. Intellectual Property

The Service, including its design, code, algorithms, branding, logo, and all associated intellectual property, is owned by Kreiso and protected by applicable intellectual property laws. These Terms do not grant you any rights to Kreiso's intellectual property except the limited right to use the Service as intended.

You must not copy, modify, distribute, sell, or create derivative works based on the Service or any part of it without our prior written consent.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, available at kreiso.app/privacy. The Privacy Policy explains what data we collect, how we use it, and your rights regarding your data.

11. Third-Party Services and Venues

The Service may contain links to third-party websites, apps, or services, or facilitate events at third-party venues. Kreiso does not control and is not responsible for the content, policies, or practices of any third-party service or venue. Your interactions with third parties are solely between you and the third party.

12. Availability and Modifications

We aim to keep the Service available and functioning, but we do not guarantee uninterrupted or error-free operation. We reserve the right to:

  • Modify, suspend, or discontinue any part of the Service at any time
  • Change features, matching algorithms, or event formats
  • Limit availability to specific geographic areas

We will make reasonable efforts to notify users of significant changes.

13. Termination

13.1 By You

You may delete your account at any time through the app or by contacting us at nikitakonst1@gmail.com. Upon deletion, your data will be handled according to our Privacy Policy (180-day retention period before permanent deletion).

13.2 By Kreiso

We may suspend or terminate your account at any time if:

  • You violate these Terms
  • Your behavior poses a risk to other users or the integrity of the Service
  • We are required to do so by law

We will notify you of the reason for termination unless doing so would compromise safety or a legal obligation. If your account is terminated for reasons other than a Terms violation, any prepaid fees for unused events will be refunded.

13.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will survive, including: Sections 6.3 (Assumption of Risk), 8.1 (license to User Content already submitted), 9 (Intellectual Property), 14 (Disclaimers), 15 (Limitation of Liability), and 16 (Governing Law).

14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

KREISO DOES NOT WARRANT THAT:

  • THE SERVICE WILL MEET YOUR EXPECTATIONS
  • MATCHING OR GROUP FORMATION WILL RESULT IN FRIENDSHIPS OR SATISFACTORY SOCIAL OUTCOMES
  • EVENTS WILL PROCEED AS PLANNED
  • OTHER USERS WILL BEHAVE APPROPRIATELY
  • THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE

KREISO DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS ON USERS AND DOES NOT VERIFY THE ACCURACY OF INFORMATION PROVIDED BY USERS.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • KREISO'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO KREISO IN THE 12 MONTHS PRECEDING THE CLAIM, OR €100, WHICHEVER IS GREATER.
  • KREISO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR YOUR PARTICIPATION IN EVENTS.
  • KREISO SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM THE CONDUCT OF OTHER USERS, WHETHER ONLINE OR OFFLINE.

THESE LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY OF THE CLAIM AND EVEN IF KREISO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY FOR: (A) DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE; (B) FRAUD OR FRAUDULENT MISREPRESENTATION; OR (C) ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

16. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of laws provisions.

Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Munich, Germany.

If you are a consumer resident in the European Union, you also have the right to bring proceedings in the courts of your country of residence. Nothing in these Terms affects your rights as a consumer under mandatory consumer protection laws of your country of residence.

The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not obligated to participate in dispute resolution proceedings before a consumer arbitration body, but may choose to do so.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through a prominent notice within the Service at least 14 days before the changes take effect.

Your continued use of the Service after the effective date of the updated Terms constitutes acceptance. If you do not agree with the changes, you may delete your account before the changes take effect.

18. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Kreiso regarding the Service, and supersede all prior agreements, representations, and understandings.
